  4. The Controller has not appointed a Data Protection Office

II. Sources and Categories of Processed Personal Data

  1. The Controller processes personal data that you have provided or personal data obtained based on fulfilling your order.
  2. The Controller processes your identification and contact details and data necessary for contract performance.

III. Legal Basis and Purpose of Processing Personal Data

  1. The legal basis for processing personal data is:
    1. Performance of the contract between you and the Controller under Article 6(1)(b) of GDPR,
    2. The Controller’s legitimate interest in direct marketing (especially for sending commercial communications and newsletters) under Article 6(1)(f) of GDPR,
    3. Your consent to processing for direct marketing purposes (especially for sending commercial communications and newsletters) under Article 6(1)(a) of GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, if no goods or services have been ordered.
  2. The purpose of processing personal data is:
    1. Processing your order and exercising rights and obligations arising from the contractual relationship between you and the Controller. When placing an order, personal data necessary for successful order fulfillment (name, address, contact) is required. Providing personal data is a necessary requirement for concluding and fulfilling the contract; without providing personal data, the contract cannot be concluded or fulfilled by the Controller,
    2. Sending commercial communications and conducting other marketing activities.
  3. The Controller does not engage in automated individual decision-making under Article 22 of GDPR. You have given your explicit consent to such processing.

IV. Data Retention Period

  1. The Controller retains personal data:
    1. For the period necessary to exercise rights and obligations arising from the contractual relationship between you and the Controller and to enforce claims from these contractual relationships (for 15 years from the termination of the contractual relationship).
    2. Until the consent to process personal data for marketing purposes is withdrawn, but no longer than 5 years if personal data is processed based on consent.
  2. After the retention period expires, the Controller will erase personal data.

V. Recipients of Personal Data (Controller’s Subcontractors)

  1. Recipients of personal data are individuals:
    1. Involved in the delivery of goods/services/payment processing under a contract,
    2. Providing operational service support,
    3. Providing marketing services.
  2. The Controller does not intend to transfer personal data to a third country (a country outside the EU) or an international organization. Recipients of personal data in third countries are mailing service/cloud service providers.

VI. Your Rights

  1. Under the conditions set out in GDPR, you have:
    1. The right to access your personal data under Article 15 of GDPR,
    2. The right to rectify personal data under Article 16 of GDPR or restrict processing under Article 18 of GDPR,
    3. The right to erasure of personal data under Article 17 of GDPR,
    4. The right to object to processing under Article 21 of GDPR,
    5. The right to data portability under Article 20 of GDPR,
    6. The right to withdraw consent in writing or electronically at the address or email of the Controller specified in Article III of this Policy.
  2. Furthermore, you have the right to lodge a complaint with the Office for Personal Data Protection if you believe your right to personal data protection has been violated.

VII. Conditions of Personal Data Security

  1. The Controller declares that all appropriate technical and organizational measures have been taken to secure personal data.
  2. The Controller has taken technical measures to secure data storage and personal data storage in physical form, particularly in the form of antivirus programs and securely stored backups.
  3. The Controller declares that personal data is only accessible to authorized persons.

VIII. Final Provisions

  1. By submitting an order via the online order form, you confirm that you have read the personal data protection terms and fully accept them.
